Britain, Ireland and the British
Dominions beyond the Seas, Em-
peror of India, and His Majesty
the King of Roumanis,

Desiring to facilitate and ex-
fend still further the trade and
commerce , of their respective
countries and to regulate by
means of a Treaty the commercial
relations between Great Britain
and Northern Ireland and such
other territories under the sove-
reignty, protection or authority
of His Britannic Majesty as he
may desire should be bound by
the Treaty ¢n the one side, and
Roumania on the other side,

Have resolved to conclude a
Treaty for this purpose, and have
appointed as their plenipoten-

lows :—

ARTICLE 1.
The territories of the High
Contracting Parties to which the
present Treaty applies are, on the
part of His Britannic Majesty,
Great Britain and Northern Ire-
land, together with any territories
“0 which the Treaty may have
oeen extended under Article 35
or in respect of which notice of
application has been given under
Article 34,and on the part of His
Majesty the King of Roumania
the entire territories which con-
stitute the Kingdom of Roumania.

The expression “ territories ” of
one or of the other High Con-
fracting Party shall be deemed
to mean those territories of such
High Contracting Party to which
the Treaty applies.

ARTICLE 2.
The rights conferred by the
present Treaty upon subjects of
His Britannic Majesty shall be
enjoyed equally by all persons
belonging to any territory under
His Britannic Majesty's protec-
bon or suzerainty or in respect
of which a Mandate has been
accepted by His Majesty, so long
as the provisions of this Treaty
have been made applicable to
that territory under the provi-
sions of Article 34.

The expression * companies of
the High Contracting . Parties ”
shall, for the purposes of this
Treaty, be interpreted in the case
of either High Contracting Party

and other companies, partner-
ships and associations, and Jjuri-
dical persons, formed for the
purpose of commerce, finance,
industry, transport or any other
business, and duly constituted in

ARTICOLUL 2.
De drepturile conferite prin
prezentul tratat supusilor Ma-
jestitii Sale Britanice se vor
»ucura in mod egal toate per-
soanele apartindnd oricdrui teri-
soriu aflat sub protectia sau
juzeranitatea Majestitii Sale
Sritanice, sau cu privire la care
Majestatea Sa a acceptat un
mandat, atdt timp ct prevede-
rile acestui tratat au devenit
aplicabile acelui teritoriu,conform
lispozitiunilor articolului 34.

Expresiunea “societitile Inal-
ielor Parti Contractante” va fi
nterpretatd, pentru scopurile
icestui tratat, in ce priveste
umbele Inalte Parti Contractante,
:a referindu-se la societiitile cu
rispundere limitatd gi alte
jocietdti, societdti in nume co-
lectiv, asociatiuni 8i persocane
juridice create cu scop comercial,
financiar, industrial, de transport,
sau orice alt gen de intreprindere,

in the territories of that Party.

ARTICLE 3.

All vessels which, according to
British law, are deemed to be
British vessels, and all vessels
which, according to Roumanian
Jaw, are deemed to be Roumanian
vessels, shall, for the purposes of
this 'I'reaty, be deemed British
and Roumanian vessels respec-
tively.

ARTICLE 4.

The subjects of either of the
High Contracting Parties shall
be entitled to enter, travel, and
reside in the territories of the
other so long as they satisfy and
observe the conditions and regula-
tions applicable to the entry,
travelling and residence of all
foreigners.

ARTICLE B
In so far as taxes, exactions,
customs duties, imposts, fees which
are substantially taxes, and other
similar charges are concerned, the
subjects of each of the.High Con-
tracting Parties in the territories
of the other shall enjoy, in regard
bo their persons, their property,
rights and interests, and in regard
to their commerce, industry, pro-
fession,occupation and every other
matter, in every respect treatment
and legal protection not less
favourable than that accorded to
the subjects of that Party or the
snbjects or citizens of the most
favoured foreign country.

Nothing in this ‘Article shall
prejudice the right of either High
Contracting Party to continue to
require all foreigners residing in
his territories to pay registration
or similar fees.

aplicabile la intrarea, cildtoria si
sederea tuturor strainilor.
ARTICOLUL 5.
In ceeace priveste verice taxe,
déri, taxe vamale, impozite, con-
tributiuni, care sunt de natura
‘axelor, si orice alte sarcini
similare, supusii fiecdreia dintre
[naltele Pirti Contractante se vor
bucura pe teritoriile celeilalte
Inalte Pirti Contractante, relativ
la persoana, proprietatea, drep-
turile gi interesele lor, precum
3i la comertul, industria, pro-
fesiunea, ocupafiunea lor, gi in
orice alti materie,de un tratament
si de o protectie legald in orice
privintd nu mai putin favorabild
lecdt aceia acordatd supusgilor
acelel Parti, sau supusilor ori
setatenilor statului striin celui
mai favorizat.

Nimic in acest articol nu
va prejudicia- asupra dreptului
fecareia dintre Inaltele Idrti
Contractante, de a continua si
pretindd tuturor striinilor gezind
pe teritoriul siu, a pliti taxe
de inregistrare sau alte taxe
similare.

        ARTICLE 6.
The High Contracting Parties
agree that in all matters relating
to commerce, navigation and in-
lustry, the carrying on of any
description of business, and the
axercise of professions or occupa-
tions in conformity with the laws
in force, any privilege, favour or
immunity which either of the
High Contracting Parties has
actually granted, or may hereafter
grant, to the ships and subjects
or citizens of any other foreign
country shall be extended, simul-
taneously and unconditionally,
without request and without
compensation, to the ships and
subjects of the other, it being
their intention that their relations
shall be placed in all respects on
the footing of the most favoured
foreion country.

ARTICLE 7.

The subjects of each of the
High Contracting Parties in the
erritories of the other shall be
at full liberty to acquire and
possess every description of pro-
perty, movable and immovable,
which the laws of the other High
Contracting Party permit, or
shall permit, the subjects or
citizens of any other foreign
country to acquire and possess.
I'hey may dispose of the same
by sale, exchange, gift, marriage,
testanient, or in any other
manner, or acquire the same by
inheritance, under conditions not
less favourable than those which
are, or shall be, established with
recard to subjects of the other
High Contracting Party or sub-
jects or citizens of the most
‘favoured foreign country.

They shall not be subjected in
any of the cases mentioned in the
foregoing paragraph to any taxes,
imposts or charves of whatever

Inaltele Pirti Contractante

alt stat striin, si fie extinse,
simultan si neconditionat, fara

Parti, fiilnd in intentia lor de a
pune raporturile lor, in toate
privintele, pe baza situatiunei
atatuliai strain celui mai favorizat.

ARrTicoLuL T.
Supusii fiecdreia dintre Inaltele
Parti Contractante, pe teritoriile
Jeleilalte, vor avea deplind liber-
tate de a dobAndi si poseda orice
fel de proprietate, mobili sau
'mobild, pe care legile celeilalte
{nalte Parti Contractante permit,
sau vor permite, si dobindeascd
si si posede supusgii sau cetitenii
yricdrui alt stat striin—Ei vor
putea dispune de ele prin vanzare,
jchimb, donatie, cisitorie, testa~
ment sau in orice alt wod, si le
jobandeasci prin mogtenire, in
sonditiuni nu mai putin favora-
hile decht acelea care sunt sau
vor fi. stabilite cu privire la
supugii celeilalte Inalte Parti
Jontractante, sau supusii ori
setitenil celui mai favorizat stat
train.

Ei nu vor fi supusi, in niciunul

than those which are, or shall be,
applicable to the subjects of the
other High Contracting Party or
the subjects or oitizens of the
most favoured foreign country.
They shall also be permitted
freely to export their property
and their goods in general and
shall not be subjected in these
matters to any other restrictions
or to any other or higher duties
than those to which native sub-
jects or the subjects or citizens of
any other foreign country would
be liable in similar circumstances.

ARTICLE 8.
The subjects and companies of
sither of the High Contracting
Parties in the territories of the
ther may, provided they con-
form to the laws in force in those
territories, employ for the pur-
pose of carrying on their com-
merce any agents whom they
may think fit.

The subjects and companies of
cach of the Migh Contracting
Parties in the territories of the
other shall have free access to
the courts of justice for the
prosecution and defence of their
rights without other conditions,
restrictions or taxes beyond those
imposed on native subjects and
companies and shall, hke them,
be at liberty to employ, in all
causes, a8 their advocates, attor-
neys or agents, persons chosen
from among those admitted to
the exercise of those professions
according to the laws of the
territories in question.

ARTICLE 9.
The subjects of each of the
High Contracting Parties in the
territories of the other shall be
exempted from all compulsory

acele teritorii, pentru exercitarea
somertului lor, orice prepus
fagent), pe care il vor gisi de

dintre Inaltele Parti Contrac-
tante, pe teritoriile Celeilalte, vor
avea liber acces la instantele
judiciare pentru urmirirea 8i
apirarea drepturilor lor, fird alte
sonditiuni, restrictiuni sau taxe,
‘n afard de acelea impuse supu-
silor gi societitilor indigene, si
vor avea dreptul, ca si acestia, si
‘ntrebuinteze in toate cauzele, ca
avocati, imputerniciti (attorneys)
saul prepusi ai lor, persoane alese
dintre acelea admise a exercita
asemenea  profesiuni, conform
legilor teritoriilor in chestinne

ARTICOLUL 9.
Supusgii fiecireia dintre Inaltele
Parti Contractante, pe teritoriile
Celeilalte, vor fi scutiti de orice
serviciu militar obligator. oricare

        military service whatsoever,
whether in the army, navy, air
force, national guard or militia,
and from the performance of all
judicial, administrative and muni-
cipal functions whatever, other
than those imposed by the laws
relating to juries. They shall
also be exempted from all con-
tributions, whether in money or
in kind, imposed as an equivalent
for such service or for the per-
formance of such functions.

The subjects and companies of
one of the High Contracting
Parties shall in no case be liable
in the territories of the other to
any military or civil requisitions
other than such as may be levied
on the subjects or companies of
the other High Contracting
Party, and shall be accorded
adequate payment therefor, which
shall in no case be less than the
payment accorded in similar cir-
sumstances to the subjects or
compapies of the other High
Contracting Party. Furthermore,
in all matters relating to military
or civil requisitions the subjects
and companies of each of the
High Contracting Parties shall
not be accorded in the territories
of the other less favourable
treatment than that which is, or
may be, accorded to subjects or
citizens or companies of the
most favoured foreign country.

ArTtIicLE 10.
The companies of either of
the High Contracting Parties
shall be entitled, in the territories
of the other High Contracting
Party, to exercise their rights
and appear in the courts either
as plaintiffs or defendants, subject
to the laws of such other Party.

Each of the High Contracting
Parties undertakes to place no

ArTICOLUL 10.
Societitile fiecireia  dintre
[naltele Parti Contractante vor
i indreptitite, pe teritoriile
seleilalte Inalte Parti Contrac-
ante, si exercite drepturile lor,

judecitoresti, fie ca reclamanti,
fie ca para{i, conform legilor
acelei Inalte Parti.

Fiecare dintre Inaltele Pirti
Contractante se obligd si nu puni

        obstacle in the way of the com-
panies of the other High Con-
tracting Party which may desire
to carry en in his territories,
whether through the establish-
ment of branches or otherwise,
any description of business which
the companies, partnerships and
associations or subjects or citizens
of any other foreign country are,
or may be, permitted to carry on
according to the laws in force.

The grant to the companies of
either High Contracting Party of
the right permanently to carry
on their regular commerce or
industry in the territories of the
other shall be governed by the
laws and regulations which are,
or may in future be, in force in
those territories.

The companies of either High
Contracting Party shall enjoy in
the territories of the other, so
far as concerns taxes, exactions,
customs duties, imposts, fees
which are substantially taxes, and
other similar charges, treatment
no less favourable than that
accorded to the companies of the
other High Contracting Party.

In no case shall the treatment
accorded by either of the High
Contracting Parties to companies
of the other be less favourable in
respect of ‘any matter whatever
than that accorded to companies,
partnerships and associations of
the most favoured foreign country.

ARTICLE 11.

Articles produced or manufac-
tured in the territories of one of
the High Contracting Parties,
imported into the territories of
the other, shall not be subjected
to other or higher duties or
charges than those paid on the

vamale, impuneri, contributiuni
care sunt de natura taxelor, si
orice alte sarcini similare, de un
tratament nu mai putin favorabil
lect acel acordat societitilor
celeilalte Inalte Pirti Contrac-
taute.

Tratamentul acordat de citre
fiecare dintre Inaltele Pari
Contractante societitilor celei-
lalte Parti, nu va putea fi in nici
an caz mai putin favorabil, in
nicl 0 privinta, decit acel acordat
societitilor ‘anonime, in nume
colectiv sau asociatiunilor apar-
tindnd statului strdin celui mai
tavorizat.

ARTICOLUL 11.
Articolele produse sau fabri-
cate pe teritoriile uneia dintre
Inaltele Parti Contractante, im-
portate in teritoriile Celeilalte,
nu vor fi supuse la taxe deosebite
sau mai mari decat acele plitite
asupra articolelor similare, pro-

        like articles produced or manu-
factured in any other foreign
country.

Articles produced or manufac-
tured in ‘the territories of His
Britannic Majesty shall not be
subject on importation into
Roumania to rates of import
duty other or higher than the
minimum rates of duty prescribed
for the like articles in the
Roumanian Tariff Law, which is
or may be at any time in force.

ARTICLE 12.

The provisions of the preceding
Articles providing for the grant
of the treatment accorded to the
most favoured foreign country do
not apply to—
(a) privileges which are, or
may be, accorded by one of the
High Contracting Parties with a
view to facilitating frontier
traffic with adjacent countries in
% zone not exceeding 15 kilo-
metres on each side of the
frontier;

(b) special arrangements which
may be made in tariff matters for
the admission into Roumania of
z00ds consigned to the Roumanian
State for use in State enterprises
in pursuance of financial settle-
ments resulting from the late
European war :

cu scop de a inlesni traficul
de frontierd cu tdrile limitrofe

metri de fiecare parte a frontierei ;

(b) aranjamentele speciale cari
ar putea fi ficute in chestiuni
tarifare pentru admiterea in
Roménia de mirfuri atribuite
Statului Romén, spre a fi in-
trebuintate in  intreprinderile
Statului, ca urmare a aranja-
mentelor financiare rezultind din
rdzboiul trecut;

(¢c) drepturile si privilegiile
acordate la unul sau mal multe
alte state limitrofe, in scop de a

ARTICLE 14.

No prohibition or restriction
shall be maintained or imposed
on the importation of any article,
produced or manufactured in the
territories of either of the High
Contracting Parties, into the
territories of the other, which
shall not equally extend to the
importation of the like articles
produced or manufactured in any
other foreign country.

No prohibition or restriction
shall be maintained or imposed
on the exportation of any article
from the territories of either of
the High Contracting Parties to
the territories of the other which
shall not equally extend to the
exportation of the like articles to
any other foreign country.

Exceptions to the general rule
laid down in the preceding para-
graphs of this Article may only
be made in the case of—

(1) prohibitions or restrictions
imposed in the interests of public
security ;

(2) prohibitions or restrictions
regarding traffic in arms, ammuni-
tion and implements of war, or,
in exceptional circumstances, all
sther military supplies:

(3) prohibitions or restrictions
imposed for the protection of
public health ;

(4) prohibitions or restrictions
imposed for the protection of
animals or plants, including pro~
tection against disease. degenera-
tion or extinction, as well as
measures taken against harmful
seeds, plants and animals.

ArTICLE 15.
In so far as prohibitions or
restrictions may be enforced on
the importation or exportation
of any goods, the High Con-
iracting Parties undertake as
regards’ import and export
licences to do everything in their
power to ensure—
(@) that the conditions to be
tultilled and the formalities to be
observed in order to obtain such
licences should be brought imme-
liately in the clearest and most
definite form to the notice of the
public ;

(b) that the method of issue
of the certificates of licences
should be as simple and stable
a8 possible ;

(¢) that the examivation of
applications and the issue of
licences to the applicants should
be carried out with the least
possible delay ;

(d) that the system of issuing
licences should be such as to
prevent the traffic in licences.
With this object, licences, when
issued to individuals, should state
the name of the holder and
should not be capable of being
used by any other person :

(¢) that, in the event of the
fixing of rations, the formalities
required by the importing country
should not be such as to prevent
AD equitable allocation of the
quantities of goods of which the
importation is authorised.

The conditions under which
licences are given for goods pro-
luced or manufactured in the
berritories of one of the High
Contracting Parties imported
nto or exported to the territories
of the other shall be as favour-
able as the conditions under
which licences are given in the
case of any other foreign country.

ARTICLE 16,
The provisions of this Treaty
relating to prohibitions or restric-
fions on importation and expor-
sation do not apply to the trade
in opium and other substances
included now or hereafter within
the scope of the International
Opium Convention signed at
Geneva on the 19th February,
1925, it being understood that
such trade shall remain subject
to the laws and regulations in
force in the territories of the
High Contracting Parties.

ARTICLE 17.
Internal duties levied within
she territories of either of the
High Contracting Parties for the
benefit of the State, or local
authorities or corporations on
goods the produce or manufac-
ture of the territories of the
other Party shall not be other
or greater than the duties levied
in similar circumstances on the
like goods of national origin,
provided that in no case shall
such duties be more burdensome
shan the duties levied in similar
circumstances on the like goods
of anv other foreivn country.

ARTICLE 18.
The High Contracting Parties
agree with respect to the treat-
ment of commercial travellers and
samples to accord to each other in
their territories all those facilities
and privileges which are set out
in the International Convention
relating to the Simplification of
Customs Formalities signed at
Geneva on the 3rd November.

ARTICLE 19.

The measures taken by the
High Contracting Parties for
regulating and forwarding traffic
across their territories shall facili-
tate free transit by rail or water-
way on routes in use convenient
for international transit. No dis-
tinction shall be made which is
based on the nationality of per-
sons, the flag of vessels, the place
of origin, departure, entry, exit or
destination, or on any circums-
stances relating to the ownership
of goods or of vessels, coaching
or goods stock, or other means of
transport.

In order to ensure the applica-
tion of the foregoing provisions,
the High Cuntracting Parties will
allow transit in accordance with
the customary conditions and
reserves across their territorial
waters.

Traffic in transit shall not be
subject to any special dues in
respect of transit (including entry
and exit) except such dues as are
intended solely to defray expenses
of supervision and administration
entailed by such transit.

The preceding dispositions in
no way affect the customs laws
concerning the treatment of
transit goods, nor the regulations
concerning goods which are the
subject of an internal duty or of
a State monopoly. The transit
of such goods shall, however, not
be restricted more than is
necessary to secure that in the
case of goods remaining in the
territories of either Party the in-
ternal duties are collected and the
object of the monopoly assured.

Neither High Contracting [arty
shall be bound by this Article to
afford transit for passengers whose
admission into his territories is
forbidden, or for goods of a kind
of which the importation or ex-
portation is prohibited, either on
grounds of public health or se-
curity, or as a precaution against
diseases of animals or plants.

For the purposes of this Article,
persons, baggage and goods, and
also vessels, coaching and goods
stock and other means of trans-
port, shall be deemed to be in
transit across the territories of
one of the High Contracting
Parties when the passage across
such territories, with or without
transhipment, warehousing, break-
ing bulk, or change in the mode
of transport, is only a portion of
a complete journey, beginning and
terminating beyond the frontier
of the territories of the Party
across which the transit takes
place.
ARTICLE 20.
Each of the High Contracting
Parties shall permit the importa-
tion or exportation of all mer-
chandise which may be legally
imported -or exported, and also
the carriage of passengers from
or to their respective territories,
upon the vessels of the other;
and such vessels, their cargoes
and passengers shall enjoy the
same privileges as, and shall not
be subjected to any other or
higher duties or charges than,
national vessels and their cargoes
and passengers or the vessels of
any other foreign country and
their cargoes and passengers.

ARTICLE 21.
In all that regards the station-
ing, loading and unloading of
vessels in the porte, docks, road-

citura si pasagerii lor, i nu vor
fi supuse nici unei taxe sau im-
puneri deosebite san mai mari

shall be granted by either Party
to vessels of any other foreign
country or to national vessels
which is not equally granted to
vessels of the other Party from
whatsoever place they may arrive
and whatever may be their place
of destination.

ARTICLE 22.
In regard to duties of tonnage
harbour, pilotage, lighthouse
quarantine or other analogous
duties or charges of whatever
denomination, levied in the name
or for the profit of the Govern-
ment, public functionaries,
private individuals, corporations
or establishments of any kind,
the vessels of each of the High
Contracting Parties shall enjoy
in the ports of the territories of
the other treatment at least as
favourable as that accorded to
national vessels or the vessels of
any other foreign country.

All dues and charges levied for
the use of maritime ports shall
be duly published before coming
into force. The same shall apply
to the byelaws and regulations of
the ports. In each maritime port
the port authority shall keep
open for inspection by all persons
concerned a table of the dues and
charges in force, as well as a copy
of the byelaws and reculations.

ARTICLE 93
The provisions of this Treaty
relating to the mutual concession
of national treatment in matters
of navigation do not apply to
the coasting trade, in respect of
which the subjects and vessels

ARTICOLUL 23.

of each of the High Contracting
Parties shall enjoy in the terri-
tories of the other, treatment as
favourable as that granted to the
most favoured foreign country.

In the event of the coasting
trade of either Party being
exclusively reserved to national
vessels, the vessels of the other
Party may nevertheless proceed
from one port to another, either
for the purpose of landing the
whole or part of their cargoes or
passengers brought from abroad,
or of taking on board the whole
or part of their cargoes or
passengers for a foreign destina-
tion. Such vessels shall, more-
over, if engaged in trade to or
from places not within the limits
of the coasting trade so reserved,
not be prohibited from the
carriage between two ports of
the territories of the first Party
of passengers holding through
tickets or merchandise consigned
on through bills of lading to or
from places not within the above-
mentioned limits, and while
engaged in such carriage these
vessels and their passengers and
cargoes shall enjoy the full privi-
leges of this Treaty.

ARTICLE 24.
The provisions of this Treaty
relating to the grant of national
treatment or the treatment
accorded to the most favoured
foreign country do not apply to
the ships of the High Contracting
Parties so far as concerns
(1) fishing in the territorial
waters of the High Contracting
Parties ;

(2) the application of special
measures for the eneouragement
of national shipping by means of
subsidies ;

(3) privileges granted to nauti-
nal sports clubs:

ce priveste —
(1) pescuitul in apele teri-
toriale ale Inaltelor Parti Con-
tractante ;

(2) aplicarea de misuri speciale
pentru incurajarea navigatiunei
nationale prin subventii:
(3) privilegiile acordate club-
urilor de sporturi de api ;

port, roadstead or beach services,
including pilotage, towage, salvage
and assistance in distress.

The provisions of this Treaty
shall not prevent the Roumanian
Government from reserving to
Roumanian ships owned wholly
or partly by the State a special
area in its ports for the berthing
of these ships and for the use in
that area of special apparatus for
bheir refuelling and for the ware-
housing and handling of the goods
which they carry, it being under-
stood, however, that this provision
shall not be so interpreted as to
deprive British ships of reasonable
facilities for carrying on their
business.

ARTICLE 25.
Notwithstanding the provisions
of this Treaty neither High Con-
bracting Party shall be required
to admit the vessels of the other
bo participate in the navigation
on inland waterways which are
not internationalised, so long as
such waters are not thrown open
to the vessels of any other non-
limitrophe foreign country.

ARTICLE 26.
Any vessels of either of the
High Contracting Parties which
may be compelled by stress of
weather, or by accident, to take
shelter in a port of the territories
of the other, shall be at liberty
bo refit therein, to procure all

bound to conform to the regula-
tions and tariffs of the place to
which he may have come.

If any vessel of one of the
High Contracting Parties shall
run aground or be wrecked upon
the coasts of the territories of
the other, such vessel and all
parts thereof and all furniture
and appurtenances belonging
thersto, and all goods and mer-
chandise saved therefrom, in-
cluding any which may have
been cast into the sea, or the
proceeds thereof, if sold, as well
as all papers found on board
such stranded or wrecked vessel,
shall be given up to the owners
of such vessel, goods, merchan-
dise, &amp;e., or to their agents when
claimed by them. If there are
no such owners or agents on the
spot, then the vessel, goods,
merchandise, &amp;c., referred to
shall, in so far as they are the
property of a subject or company
of the first High Contracting
Party, be delivered to the con-
sular officer of that Party in
whose district the wreck or
stranding may have taken place
upon being claimed by him
within the period fixed by the
laws of the other High Con-
tracting Party, and such consular
officer, owners, or agents shall
pay only the expenses incurred
in the preservation of the pro-
perty, together with the salvage
or other expenses which would
have been payable in the like
case of a wreck or stranding of
a national vessel.

The High Contracting Parties
agree, however, that merchandise
saved shall not be subjected to
the payment of any customs
duty unless cleared for internal
consumption.

In the case of a vessel being
driven in by stress of weather,
run aground or wrecked, the
respective consular officer shall,
if the owner or master or other
agent of the owner is not present,
or is present and requires it, be
authorised to take steps in order
to afford the necessary assistance
to his fellow-countrymen.
ARTICLE 27.
It shall be free to each of the
High Contracting Parties to
appoint consuls-general, consuls,
vice-consuls, and consular agents
bo reside in the towns and ports
of the territories of the other
Party to which such representa-
tives of any other nation may
be admitted by the respective
Governments. Such consuls-
general, consuls, vice-consuls, and
consular agents, however, shall
not enter upon their functions
until after they shall have been
approved and admitted in the
usual form by the Government
to which they are sent.

The consular officers of one of
the High Contracting Parties
shall enjoy in the territories of
the other Party the same official
rights, privileges and exemptions,
provided reciprocity be granted,
as are, or may be, accorded to
similar officers of any other
foreign country.
ARTICLE 28.
In all that concerns the ad-
ministration of the estates of
deceased persons, any right,
privilege, favour or immunity
which either High Contracting
Party has actually granted, or
may hereafter grant, to the con-
sular officers of any other foreign
country shall be extended imme-
diately and unconditionally to the
consular officers of the other
High Contracting Party.

The consular officers of one of
the High Contracting Parties
residing in the territories of the
other shall receive from the local
authorities such assistance as can
by law be given to them for the
recovery of merchant seamen

the latter High Contracting Party,

ArTICLE 30.
The subjects and companies of
sach of the High Contracting
Parties shall have in the terri-
tories of the other the same rights
as subjects or companies of that
High Contracting Party in regard
to patents for inventions, trade-
marks, trade names, designs, and
copyright in literary and artistic
works, upon fulfilment of the
formalities prescribed by law.

Each High Contracting Party
undertakes to adopt all the
necessary legislative and ad-
ministrative measures in order
bo assure to goods produced or
manufactured in the territories
of the other Party effective pro-
tection against all forms of unfair
competition in commercial trans-
actions and in particular in order
to repress and prohibit by seizure
and by other appropriate remedies
the importation, exportation,
distribution, sale or offering for
sale of all products bearing upon
themselves or their usual get-up
or wrappings, or the invoices
relating thereto, any marks,
names, devices or inscriptions
whatever, which are calculated
bo convey directly or indirectly

comerciale, desenurile gi copy-

ARTICOLTUT. 31
Fiecare din Inaltele Parti Con-

seristics of such goods.

[t is understood that the pro-
visions of this Article do not
impose any obligation to seize
goods in transit.

The procedure of enquiry and

the enforcement of the measures
referred to above shall be carried
out in the territories of each
High Contracting Party in con-
formity with the domestic legis-
lation of each Party either at
the instance of the appropriate
official authority or at the re-
quest of persons or associations
interested in the protection of a
particular industry through the
Intermediary of their properly
qualified representatives.
. In respect of goods which are
imported into, or to which a
mark or description has been
applied within, the territories of
ne of the High Contracting
Parties, the competent authorities
of that Party shall decide what
descriptions, on account of their
generic character, do not fall
within the provisions of this
Article.
ARTICLE 89.
The High Contracting Parties
Agree in their relations with each
dther to give effect in their
serritories to the provisions of—
(1) the conventions and statutes
concluded at Barcelona in 1921
respecting freedom of transit and
navigable waterways of inter-
national concern ;

(2) the convention and statutes
concluded at Geneva in 1923
respecting customs formalities
and railways.

ARTICLE 33.
The High Contracting Parties
agree that any dispute which may
arise between them as to the

tion of any of the provisions of
the present Treaty shall be sub-
mitted to the decision of the
Permanent Court of International
Justice at The Hague,

Nevertheless, any disputes
which may arise as to the treat-
ment of goods or the application
of the provisions relating to tariff
questions or navigation,and which
require immediate settlement,
shall be submitted, at the request
of either of the High Contracting
Parties; to an arbitral tribunal
established for each dispute and
composed of three members, of
whom each of the High Contract-
ing Parties will nominate one,
and the third shall be appointed
by agreement between the two
High Contracting Parties, or,
failing agreement between them,
by the President of the Permanent
Court of International Justice.

The decisions of this tribunal
will be final and possess binding
force.

ARTICLE 34.
His Britannic Majesty may,
through his Representative at
Bucharest, give notice of his
desire that the present Treaty
shall apply to any British colony
or protectorate or to any man-
dated area administered by his
Government in the United King-
dom of Great Britainand Northern
Ireland and, from the date of the
said notice the Treaty shall be in
force as between Roumania and
the territory specified in such
notice.

As regards any such territory
in respect of which the present
Treaty shall have been made
applicable under this Article,
either of the High Contracting
Parties shall have the right to
terminate the application of the
Treaty at any time on giving six
months’ notice to that effect.

        ARTICLE 35.
The present Treaty may by
mutual agreement be extended,
with any modifications agreed
upon, so as to apply between
Roumania and any of His Bri-
tannic Majesty's self-governing
Dominions (including any manda-
ted territories administered by
the Governments of such Do-
minions) or India, by means of
an exchange of notes between
the Roumanian Government and
the Government of any such
Dominion or of India.

After the expiry of a period of
two and a half years from the
coming into force of the present
Lreaty, either of the High Con-
bracting Parties may, by giving
SIX months’ notice, terminate the
application of the Treaty between
Roumania and any territory to
which it has heen extended
under the first paragraph of this
Article

ARTICLE 36.
So long as in any territory re-
ferred to in Articles 34 and 35,
which is not bound by the
Present Treaty, goods produced
or manufactured in Roumania are
accorded treatment as favourable
as that accorded to goods pro-
duced or manufactured in any
other foreign country, goods pro-
duced or manufactured in such
territory shall enjoy in Roumania
completely and unconditionally
the treatment of the most
favoured foreign country.

His Majesty the King of Rou-
mania shall, however, be entitled
at any time, upon giving six
monthg’ notice in writing, to
terminate the application of this
Article in respect of any of
His Britannic Majesty’s self-
rovernine Dominions or of India.

ARTICOLUL 35.

The present Treaty shall be
ratified and the ratifications shall
be exchanged at Bucharest as
soon as possible. It shall come
into force immediately on the
exchange of ratifications, and
shall be binding during a period
of three years from the date of
such exchange.

In case neither of the High
Contracting Parties shall have
given notice to the other six
months before the expiration of
the said period of three years of
his intention to terminate the
Treaty, it shall remain in force
until the expiration of six months
from the date on which notice of
such intention is given.

In the absence of an express
provision to that effect, a notice
given under the second paragraph
of this Article shall not affect the
operation of the Treaty as be-
tween Roumania and any terri-
tory to which the Treaty may
have been extended under the
provisions of Article 35.

signed the present Treaty and
have affixed thereto their seals.

I'reaty of Commerce and Naviga-
tion of this day’s date the under-
signed plenipotentiaries of His
Britannic Majesty and His
Majesty the King of Roumania
agree as follows —

(1) Goods produced or manu-
lactured in the territory of lis
Majesty the King of Iraq shall
enjoy in Roumania completely
and unconditionally the treatment
of the most favoured foreign
country so long as goods produced
or manufactured in Roumania are
accorded in the territories of His
Majesty the King of Iraq treat-
ment as favourable as that ac-
corded to goods produced or
manufactured in any other foreign
country.

(2) If at any time after the
said Treaty of Commerce and
Navigation has come into force
His Majesty the King of Iraq
shall desire to accede thereto and
a notification to that effect shall
be deposited on his behalf with
the Government of Roumania the
provisions of Articles 2 to 33
(inclusive) of the said Treaty
shall apply as from the date of
the said notification between His
Majesty the King of Roumania
on the one part and His Majesty
the King of Iraq on the other
and shall continue so to apply
until the expiration of six months
from the date of a notice of
termination given on behalf of
sither of these High Contracting
Parties,

(3) The present Protocol shall
be ratified and the ratifications
shall be exchanged at Bucharest
at the time of the ratification of
the said Treaty of Commerce and
Navigation or as soon as possible

1 HAVE the honour to inform you that His Majesty's Government,
in the United Kingdom are prepared to agree that the Treaty of
Commerce and Navigation, signed to-day, shall enter into force
provisionally as from to-morrow pending its definitive entry into
force upon the exchange of ratifications in accordance with
Article 37.

2. This note and your note in reply, informing me that the
Roumanian Government accept this proposal, shall be deemed to
constitute an agreement to this effect between the two Governments,
which shall be subject to termination at any time upon two weeks’
aotice given on behalf of either Government.

IN reply to your note of to-day’s date, I have the homour to
inform you that the Roumanian Government agree that the Treaty
of Commerce and Navigation, signed to-day, shall enter into force
provisionally as from to-morrow pending its definitive entry into

Your note, and this note in reply, shall be deemed to constitute
