 of Massachusetts 1909 p. 7: In order to give you an opportunity
to reform without punishment, the Court has placed you on probation for
the period of,.., in the care of.the Probation Officer. You must observe
the following conditions:
1. Obey such orders as the Court may make. This includes the payment
of costs, restitution or reparation, when directed.
2. Report promptly to your Probation Officer as required on the back
of this card,
3. Work regularly,
4. Keep good company and indulge in no bad habits,
If any of these conditions are violated, you will be surrendered to the
Court for sentence. Von der Massachusetts Adult Probation, namentlich auch
bei Trinkern, handelt Tallack (Penological and Preventive Principles 1889.
p. 303 ff.). Bewährung oder Fehlschlag des Probationsverfahrens hängen,
wie er mitteilt, davon ab, ob das im Interesse der Probation genommene
(aussergerichtliche) Gelübde gehalten wird oder nicht,
Anm. 24. Eine Resolution des XII Internationalen Kongresses zu London
 1909 (Report of Official Delegates etc., p. 7) spricht davon, dass das
Pollardsystem im Staate Victoria durch statute law eingeführt ist. Nach
dem Melbourne Herald vom 20. 11. 1907 ist das Pollardsystem zulässig auf
Grund des Justices Act von Victoria (sec. 191), und eine ausdrückliche Klausel
 zu seinen Gunsten aufgenommen in den Indeterminate Sentences Act,
der seit 1. Juli 1908 in Kraft ist. Ich konnte das Eintreffen dieser Gesetze
nicht abwarten. Wahrscheinlich handelt es sich um die im Texte geschilderte
 Ersatzmethode. Für diese Meinung spricht auch die Fassung des
Gelübdes: | | .

Nach dieser Gelübdeformel verspricht der Täter dem Richter sein Gelübde
 zu halten, wenn er ihn unbestraft lässt; nach dem Pollardsystem verspricht
 der Richter den Täter unbestraft zu lassen, wenn er sein Gelübde
 hält.
