Anm. 91. Nach dem First Annual Report (p. 14) soll die Probation eintreten
 in „selected cases“. Sache der Richter ist es, die Auswahl sorgfältig
zu treffen. Mit Recht sagt der First Annual Report (p. 14): „Only those persons
 should be placed upon probation of whom it is found upon careful inquiry
 into their character and surroundings and the true nature and circumstances
 of their offence, first, that they can be so placed with due regard to
the protection of society, and secondly, that they are likely to profit by
the treatment it affords.“ Die Mängel, die das Probationssystem in Massachusetts
 aufweist, führt der First Annual Report (p. 22) auf das schnelle
Wachstum des Systems zurück: it is only fair to say of the defects which
may be noted that nearly all are in consequence of the rapid growth of a
system, the real meaning of which was at first not fully appreciated. In
Massachusetts wurden vom 1. Oktober 1908 bis Ende September 1909
2,4 Prozent der Angeklagten, in England 1908 von den Gerichten mit summarischer
 Rechtsprechung fast ein Neuntel aller wegen indictable offences
Angeklagten auf Probe gestellt und von den insgesamt 8023 im gleichen
Jahre auf Probe Gestellten nur 367 wieder vor Gericht gezogen und bestraft.
Der Report of the Departmental Committee Par. 46 nimmt an, dass in
Städten ein probation officer, der seine ganze Zeit der Aufsicht widmen
kann, bei durchschnittlicher Dauer der Probation von sechs Monaten sechzig
Fälle, bei längerer Dauer der Probation aber auch eine grössere Zahl von
Fällen zugleich bewältigen kann.

Platz greifen soll, erteilt uns einen lehrreichen Wink Tallack (Penological
and Preventive Principles p. 263): Both paid and unpaid agency have, respectively,
 some particular advantages and disadvantages. Unpaid service
is often the best and most genuinely effectual, but it also sometimes involves
an undesirable irregularity and independence of action. On the other hand,
a paid agent is more amenable to rules and order, and his responsibility can
be more certainly and promptly enforced. Ähnlich Report of the Departmental
 Committee Par. 13: The regular visits and reports, the knowledge
that the supervision is not merely by the agent of a philanthropic society,
but by a person who is, in addition or alternatively, a legally appointed
officer of the court, ... all these things have a powerful influence on the

the advisability of appointing honorary probation officers, or officers employed
 for one or two cases only and paid by a fee in respect of them. It was
urged that the duties were of so special and difficult a character that only
a person who had had the training which daily experience alone can give
