GENERAL PROVISIONS.

The details of the contract must be kept secret as far as possible; neither
must communications and facts which become known in the proceedings of the
convention be used for the special propaganda of individual firms. (18 V.)
The price regulation created by the convention for the time being extends to
the home market only. (4 V.)

ForEIGN MARKETS.

For the countries in Europe, outside of Germany, and their colonies no contracts
 must be entered into by the members of the convention which take away
from the convention firm the control of price quotations beyond July 1, 1914,

EXPORT PROOFS.
It is resolved that each firm assumes or bears full responsibility for the actual
shipment of the goods to foreign countries. If there should be any irregularity
in this respect the exporting firm will have to furnish proofs showing whether
it has done anything in this respect that releases it or not. (G. V. 20. 2. 14.)
JoinT TERMS OF DELIVERY AND DEALERS’ TERMS.

The prices are in marks, including ordinary freight. Fast freight is charged
at half the fast-freight rate; postage is payable by the recipient.
The packing is charged for at cost. In connection with goods returned, with
prepayment of charges, two-thirds of the cost of packing, if the latter is in good
condition, is refunded.
The place of fulfillment for the delivery and payment is the city where the
shipper is located. ,
Claims on account of incorrect quantity and poor packing must be made
within a week after receiving the goods.
A guaranty is assumed in this way, that all b8arings which within a year
from the time they are first used, but at the latest within 15 months from the
date of delivery, become demonstrably unserviceable through defects in material
or workmanship are repaired or replaced free of charge. Any other claims are
not to be derived from the guaranty.
The bearings are replaced f. o. b. factory. The parts to be repaired must be
sent charges prepaid. Indemnity of any other kind i8 not rendered. If, in
special cases, the immediate furnishing of replacements should be-necessary
before the defective part has been returned, such replaced parts must be
charged for in the first place and the amount credited when it was found by
an inspection of the bearings that the obligation of replacement exists,
The time of delivery is figured from the receipt of the order or the final
statement concerning its execution. The maintenance of the time of delivery
agreed upon which, without a special agreement to the contrary, is of an
approximate nature (days being understood as working days), Is subject to
unforeseen processes or events in connection with the manufacture or to other
obstacles, such as cases of force majeure, delays in transportation. operating
interruptions through strikes or lockouts.
Any obligation for damages. in particular conventional penalties for shipments
 not made on time, must not be incurred.
Contracts must not be entered into in any one case for shipments beyond
the term of one year, beginning three months after the date of the contract at
the latest.
Terms of payment. A cash discount of at the most 2 per cent for cash payments,
 30 days from the date of delivery at the most, or in its place a credit
term of three months at the most.
Quotations and sales, in the absence of a special agreement to the contrary,
apply only to the buyers’ own use and expressly exclude the sale to others
in loose condition, i. e.. not mounted on machines, vehicles, apparatus, or the
like,
For reselling the ball bearings the following provisions apply:
