lower prices or on terms more advantageous than those shown by .the lists
mentioned below must not be carried out:
1. To dealers, 1. e., to such firms or persons who conduct the sale of ball
bearings as a business (automobile dealers, repair shops, garages, mechanical
workshops), or who need the bearings for their industrial operations, not
below the basic prices of the F. &amp; S. lists No. 711 and 713, on which a discount
of 20 per cent at the most is permissible. The sale to others must have for
Its basis the, general terms of delivery of the convention as set forth in the
price lists.
2. To private customers who do not make a business of the sale of ball bear-Ings,
 under no circumstances below the basic prices of the yellow price list
No. P. 720, in which connection the granting of any discount is inadmissible.
In furnishing ball bearings to firms or persons who make ga business of selling
them, these buyers must be made to agree in a legally valid form to the maintenance
 of the joint terms of delivery and resale. By the same token, the
obligation must be imposed on them that they will bind their subbuyers, if the
latter sell ball bearings, in the same manner, so that each successive dealer
Is obliged to maintain the whole of the joint terms of delivery and sale.
If offenses against the preceding terms of delivery or resale or an underbidding
 of the prices laid down are verified, the purveyors of the ball bearings are
released from any obligations toward the offenders in connection with the
ball bearings involved.
SCHEDULE B.

The sale of ball bearings on the part of all buyers must only take place by
maintaining the present joint terms governing resale, and must not be executed
at lower prices or on more advantageous terms than those indicated below.
To private customers who do not make a business of the sale of ball bearings
no ball bearings muet be sold under any circumstances below the basic prices
of the yellow list No. P 720, in which connection the granting of any discount
or allowance, by whatever name it may be called, is inadmissible.
In furnishing ball bearings to firms or persons who make a business of selling
ball bearings, these buyers must be obligated, in a legally valid form, to maintain
the ‘joint terms of delivery and sale; in like manner they must be obligated to bind
their subbuyers, if the latter conduct a ball-bearing business, in the same way,
So that each successive dealer will be obliged to maintain all of the Joint terms
of delivery and sale.
If offenses against these terms of delivery or sale or a cutting of the prices
stipulated should be proven, the purveyors are to be released from all delivery
obligations with the offenders in connection with ball bearings.
No terms must be accepted other than those laid down by the convention, and
in each quotation and confirmation of an order these terms must be pointed out,
so that conditions prescribed by the customer may not be tacitly acknowledged.
Prepayment of freight in connection with postal shipments is admissible to the
following cities: Greater Berlin, Bielefeld, Cannstatt-Stuttgart, Diisseldorf,
Leipzig, Schweinfurt, and Wetzlar, (General meeting, 10. 9, 13.)
The guarantee for the load capacity of the bearings is to be omitted from the
terms of the convention and only inserted. if a customer asks for a guarantee
of the load capacity.

REPRESENTATIVES AND DISTRIBUTORS.

The firms belonging to the convention assume full liability for the maintenance
 of the terms of the convention on the part of their representatives.
Representatives must not be allowed ,any price concessions for execution other
than those laid down in the terms of the convention, with the exception of existing
contracts. So long as these contracts are in effect—the contracts in question
have to be examined by the confidential agent and, after having been acknowl
edged as existing in due form—each firm of the convention and its representative
 is entitled to begin shipments on the terms on which the deals in
guestion are made.
No member is allowed to concede an additional commission to his representatives
 who buy articles of the convention for their own account. If, In
connection with purchases made by the representative for his own account, a
commission is allowed, the minimum prices must be correspondingly increased.
The representatives must be named to the confidential agent.
