GERMAN PORCELAIN MANUFACTURERS. .

The following is a copy of the contract between German porcelain
 manufacturers which is in full force and effect at the present
time. There is a special agreement between the members. of the
association for export to America, giving discounts as follows: Less
8 and 2 per cent plus 25 per cent advance (this advance is shown
in contract).
According to the best information obtainable, these companies
are selling abroad at less 2 per cent plus 25 per cent advance. This
makes the 8 per cent discount apply to export only, and is really the
advantage which American buyers are obtaining over foreign buyers.
In other words, these companies are selling in America at an 8 per
cent discount lower than they are selling abroad.

TERMS OF SALE OF THE ASSOCIATION OF GERMAN PorceraiN Fac-TORIES
 FOR THE DEVELOPMENT OF THE PORCELAIN INDUSTRY,
LIMITED.

The designated wares must not be sold under the foregoing specified minimum
prices, neither must wares at disposal.
Decorated wares in any designs, even in the simplest, must not be sold under
the specified minimum prices of the designated decorated wares.
Upon direct sales to personal consumers the association factories must add,
besides the association advance of 20 per cent and 2 per cent for packing
expenses, upon tableware an additional 40 per cent and upon hotel ware an
additional 20 per cent.
Upon sales to dealers who own a decorating shop or who have others decorate
for them the buyers must be pledged to sell the tablewares which they decorated
 at least 40 per cent higher, and the self-decorated hotel wares at least
20 per cent higher to others than the members are allowed to do on the basis
of the association agreement.
Decorated hotel ware may only be sold to dealers when they bind themselves
to sell the same at least 20 per cent over the minimum price, inclusive of the
association advances.
In taking new orders the members must reserve the right to stop deliveries
as soon as the customer concerned has even in a single instance violated his
assumed pledges in the sale of the wares.
Members must not again take orders for white tableware from decorators
who sell tableware, until they have received notice from the office of the
association that the decorators alluded to have pledged themselves to become
members of the association or that on account of the insignificance of their
transactions the rule under consideration has no application,
Replace pieces of decorated ware are to be charged with an extra advance
of 83% per cent. Less than six pieces per decor are to be regarded as replace
pleces. .
Replace pieces will not be charged with this advance if they are ordered
within four weeks after the bill for the service referred to was issued.
Those dealers who truthfully assure the Association of German Porcelain
Manufacturers for the Development of the Porcelain Industry that they will
in the future buy their white and decorated porcelain wares exclusively from
factories belonging to the association, will, so long as they do not recall their
declaration, be charged with an association advance of 25 per cent.
Members of the association are not allowed to deliver at all to dealers who
do not make the above declaration.
If the transactions of customers who gave the above prescribed assurance
 with the collective members of the association should amount altogether
to at least 10,000 marks, then these customers will receive a refund of 1 per
vent; upon a total turnover of at least 25,000 marks, 2 per cent; and upon a
total turnover of at least 40,000 marks, 8 per cent.
