5. The unit of weight is 1 doppelzentner (100 kilograms).
The weighing of the goods is done by the cansignor in his factory, where also
the samples are taken under the supervision of public and sworn examiners,
Each purchaser has the right to have his representative present at the weighing
 and sample taking and to demand a sample from the graded lot. Samples
shall be preserved for four months.
6. The analysis is first made bY the consignor of the goods and tested in the
laboratory of the Syndicate by two public and sworn chemists.
In case the findings of the two sworn chemists differ more than 0.8 per cent
from each other, new analyses shall be made.
The average of the findings thus determined by both sworn chemists constitutes
 the standard in each case. .
The computation of small lots of 10 doppelzentner and below shall be made
solely upon the basis of the factory analysis.
7. The payment of the purchase money shall be made in net cash in such a
way that the purchaser upon receipt of the bill shall deliver to the Syndicate
the amount of it in cash, carriage paid. At the request of the Syndicate,
however, the purchaser shall be held to furnish bank security for the amount
of the goods to be shipped before delivery or to send in the amount of the bill,
carriage paid.
Purchasers residing abroad shall present a certified credit, i. e., not subject
to recall, at a first-class bank in Germany, to be drawn upon against shipping
documents or invoices in case ocean bills of lading are made out by the purchaser.

8. The Syndicate reserves the right to have the delivery of the goods made
by one or several works belonging to it.
The place of performance and of payment shall be Berlin, the seat of the
Potash Syndicate, company with limited liability.
9. The Syndicate is free to annul sales entirely or in part in case one or
more of the potash works belonging to the Syndicate should be prevented by
force majeure (act of God) or by labor strikes in the continuance of their
business.
The prices and price increases shall be based upon the freight regulations of
the business organizations participating in the transportation.
The Syndicate shall strive to do its best to comply with the shipping direc-Hons
 given, yet it can not undertake to guarantee the delivery at a fixed date,
10. Deliveries of our salts to other foreign countries, owing to the many
exclusive agencies existing there, may be made only after a previous understanding
 with the Potash Syndicate.
11. If there is a well-founded presumption that a buyer has violated these
pxport regulations, then he is obliged to prove the contrary; in case he fails
to produce the proof the Syndicate is entitled to assume that a violation has
taken place and may demand from him the payment of a fine in settlement
amounting to 50 per cent of the value of the respective goods. This fine is
payable into the Syndicate treasury, and in case of refusal to pay it, shall
be deducted forthwith from any assets or from any security deposited by the
buyer. In addition to this the buyer has to pay damages to the Syndicate, 1. e,;
to the works, for the consequences of the contravention.
II. Special CONDITIONS.
A. CONCERNING CHKLORIDE OF POTASSIUM.

12. The Syndicate sells 11 different grades with a minimum content of 70,
75, 80, 85, 88, 90, 95, 96, 97, and 98 per cent of chloride of potassium, and with
2 minimum content of 98 per cent of chloride of potassium and a guaranteed
maximum content of one-half per cent of table salt.
For the over-sea export only the grades quoted on the export price list shall
he delivered. /
15. js regards the additional ingredients the following terms may be
agreed to.
(1) That the chloride of potassium shall not contain over 2 per cent moisture,
(2) That the chloride of potassium shall not contain more magnesia than
corresponds to a half per cent of chloride of magnesia; this condition, however,
will be agreed to only in case the maximum content of chloride of potassium
