496 REPORT ON COOPERATION IN AMERICAN EXPORT TRADE.

acting in the capacity of director of H. Cauvet Lambert &amp; Co., limited liability
company, whose head office is at Marseille, Rue de la Conception No. 20, and
in virtue of powers conferred upon him to that effect by the board of directors
of the said society; (7) Mr. Bourhis, living at Dijon, Rue d’Ile Nos. 33 and
35, acting in the capacity of director of the “ Capsulerie Moderne de Dijon,”
society limited by shares, whose head office Is at Dijon, Rue d’Ile Nos. 33 and
85, and in virtue of powers conferred upon him to that effect by the board of
directors of the above society; (8) Mr. Caillaud, living at Saumur at “ Pont-Fouchard;”
 (9) Mr. Quibel, living at Coutras (Gironde), acting in the capacity
of director of Messrs. P. Quibel &amp; Co., whose head office is at Coutras,
Gironde; (10) Mr. Sainte Marie Dupre, living at Arcuell, Felix Faure Avenue,
jointly of the first part; and Mr. Oliver H. Campbell, living in London, acting
in the capacity of director of Messrs. Betts &amp; Co, whose head office is in London,
 and in virtue of the powers conferred upon him in his said capacity, it has
been agreed as follows:
Whereas the parties state that under &amp; private contract dated Paris the ——,
an association for joint participation, was entered into between them with the
object of protecting their-common interests, of regulating competition between
them, and chiefly of compensating the underproduction of certain capsule
manufacturers by the overproduction of others, the whole in accordance with
the clauses and conditions set forth in the said contract.
And whereas Messrs. Betts &amp; Co. have a branch of their company at Bordeaux
and have taken part in the said contract in the same way as the other capsule
manufacturers therein named, and Mr. Campbell in his aforesaid capacity has
pointed out to his colleagues that Messrs. Betts &amp; Co. require an assurance
that the French capsule manufacturers should not compete with them in the
United Kingdom and should not profit by the benefits which they enjoy under
the sald agreement to compete with their company in their own country;
And whereas Messrs. ——— have admitted that the demands put forward
by Mr. Campbell are well founded:
Now it has been agreed between the parties as follows, for the purpose of
regulating the export of French capsules into the United Kingdom:
Articre IL.

It is agreed between the parties that the export of metallic capsules
United Kingdom by the different French makers shall be the following:

Messrs. Quibell &amp; Co., Cailiaud, La Capsulerie Moderne de Dijon, and Messrs.
Ste. Marie Dupre, not being exporters at the present time of metallic capsules
to the United Kingdom, hereby undertake not to export any during the existence
 of this contract.
Mr. Campbell in his aforesaid capacity accepts the figures named above by
his associates.
ArticLE II.

Should the export of metallic capsules made directly or indirectly to England
by any of the parties hereto exceed the amount allotted to him by virtue of
Article I of these presents, the said party hereby undertakes to pay Messrs,
Betts &amp; Co. a royalty of 25 per cent on the excess of his export to the United
Kingdom.
Articie ITI.

The control of the export of the metallic capsules made by each of the undersigned
 to the United Kingdom shall be conducted at each of their offices
by the manager of the association of participation mentioned above,
