E. Third class—New producers.—Besides the really new producers, those who
have shipped iodin since April 30, 1893, shall be considered as new producers.
The board of directors is authorized to make the necessary arrangements to
the end that this class shall join the combination, keeping in view the proportion
 that ought to exist between the quotas of the old and new producers, taking
 into account the restrictions to which the latter have been subjected by the
Nitrate Combination.
While the final quotas are being fixed the board of directors shall designate
for the new producers provisional quotas which shall be approximately in proportion
 to those of the other members of the combination, taking into account
their respective production. When the production is ascertained and the final
quota fixed any difference for or against the new producer shall be adjusted,
and
F. The stocks of the mere holders of stocks, to wit, the Devescovi Syndicate,
Carmen R. v de Saez, Otto Herrmann, and the Tarapaca Nitrate Co. in process
of dissolution, which amount to a total of 50 quintals, more or less, shall be
liquidated at the rate of 2 quintals a month for the first two and at the rate of 1
guintal for the last two. .
ArT. 8. The signers of this constitution must give access to their iodin factories
 at any time, and with all possible facilities for the better fulfillment of
their obligation, to an inspector named by the board of directors, who shall
perform his functions in conformity with a special set of rules drawn up by
the board of directors.
ArT. 9." In case a producer adds to his machinery the board of directors shall
have the power, if the producer asks for it, to increase his quota in proportion
to the real increase which has been made in the producing capacity of his
machinery, which must be demonstrated to the satisfaction of the board of
directors.
Notwithstanding that a works or producer has operated for nine years without
 making use of the provision in the above paragraph, he shall have the right
from that time to make the ordinary test for iodin in order that his quota
may be fixed in relation to the productive capacity of iodin demonstrated in
said test.
Any producer who stops producing nitrate in his works shall enjoy his quota
only until the stocks on hand at his own works have been exhausted. The
transfer of iodin from one producer to another or from one works to another
does not transfer the right of the quota to a closed-down works,
If work is resumed in a works which has closed down and whose stocks
have been exhausted, it shall again enjoy the quota belonging to it, beginning
with the month following that in which its first shipment of iodin arrives
abroad. .
ArT. 10. No old producer is allowed to sell or transfer fodin to a new producer
 until the final quota of the latter has been fixed. Any violation of this
provision shall be punished by a fine of £50 for ench Spanish quintal sold or
transferred, and when the violation has been proven, the board of directors
shall have the power te authorize the consignee agents of the combination in
Europe to deduct the fine from the proceeds of the next quotas belonging to the
offending member. The amount thus deducted shall be prorated among the
other members of the combination according to their quotas.
ArT. 11. Any member who sells odin outside the combination must indemnify
the other associates at the rate of £50 for each quintal thus sold.
The fine for any other violation of the provisions of this constitution shall be
determined by a friendly board of arbitration made up in conformity with the
following rules:
A. The board of arbitration shall be formed of two arbitrators or friendly
conciliators, one designated by the board of directors of the association and the
other by the offending member. Within five days following the acceptance og
their positions these two arbitrators shall name a third, who shall adjust tne
differences that arise among them;
B. In case a difference of opinion exists as to the violation of this constitution,
 the president of the board of directors of the association, or the person
acting in his place or representing him, shall have the right to bring before the
justice of the peace of Iquique a petition which shall state the specific case of
violation, designate the offending member, and name the person to be arbitimice
