512 REPORT ON COOPERATION IN AMERICAN EXPORT TRADE.

Goods shall be ordered in quantities of not less than two hundred (200)
tons of bulk goods and fifty (50) tons of bag goods to each shipment.
(13) Enhancement.—The syndicate will every year during the term of this
contract fix a “booking date” which shall be not earlier than the first day of
April in any year. On or before the date so fixed buyer shall deliver to the
syndicate or its representative in the United States a detailed statement of
its requirements of potash salts during that calendar year, together with a
detailed statement of the various grades of potash salts herein specified and
the quantities of each grade buyer so requires, which detailed statement shall
include in the aggregate a quantity of K,;0, which shall at least equal the minimum
 quantity agreed to be purchased by buyer. }
In the event of the failure of buyer so to deliver to syndicate such detailed
statement of its requirements on or before the * booking date ” so fixed, then the
base price to buyer of potash salts shall be increased by fifty (50) cents per
two thousand (2,000) pounds for concentrated salts (base muriate of potash
BO per cent, sulphate of potash 90 per cent and double manure salt 48 per cent),
and twenty (20) cents per two thousand (2,000) pounds for all crude salts,
anything herein contained to the contrary notwithstanding: Provided, however,
fhat if buyer shall have delivered a detailed statement of its requirements, as
aforesaid, on or before said * booking date ” it shall have the right to order and
purchase an additional quantity of potash salts not exceeding 80 per cent of
the quantity specified in said original detailed statement by delivering to syndicate,
 or its United States representative, on or before the following 31st day
of July, a further detailed statement of its additional requirements, specifying
in detail the various grades and quantities of each grade constituting such
additional requirement, and without enhancement of price; but if such additional
 detailed statement of such additional, requirements shall not have beer
so delivered on or before said 31st day of July, then the base price thereof shall
be enhanced as aforesaid.
(14) Interruption of navigation.—If, owing to interruption of navigation to
potash-carrying vessels, syndicate should be unable to ship potash salts from
the mines by water and should be obliged to ship the same by rail from the
mines to the seaports, buyer agrees to pay the difference between water and
rail freight for all salts which the syndicate shall be so obliged to ship by rail.
If, however, such interruption of navigation should occur in summer, buyer
has the option either to pay the said difference or to defer the shipment of
potash salts theretofore ordered by buyer until the resumption of navigation,
provided notice of desire to so defer shipment shall have been received by syndicate
 before the potash salts so ordered shall have been actually loaded on cars
at the mine, ]
Notice of interruption of navigation is to be given by syndicate to buyer as
early as possible,
(15) Strikes.—In case of war. revolution, strikes, accidents, epidemics, or
any other contingencies beyond the control of the syndicate happening to such
number of the mines or works represented by the syndicate as shall render it
Impossible to produce or ship all or any part of such goods referred to herein,
or in case the production or shipment of all or any part of such goods shall be
prevented or delayed, the syndicate shall have the right either to cancel this
contract with reference to the shipments which may be so affected or to make
the shipments after the said impediments and contingencies shall have been
removed ; in such case shipments sHall not have been delayed more than thirty
days after the time when such shipments should have been made under terms
of this contract; as to shipments for the months of October, November and
December, buyers agree to accept a delayed shipment if made prior to January
31st following. If the syndicate is unable to deliver the goods at the time, and
in the manner in said contract provided, said buyer shall have the right to pur.
chase the same in open market in amounts or quantities which have not been delivered
 by the syndicate. In case of war, rebellions, strikes, accidents, epidemics,
or in case of any contingencies happening to such number of factories owned and
operated by the buyer or its branches that the operation thereof shall be interfered
 with or interrupted in such manner as to prevent the buyer from using
in substantial and material quantities the merchandise covered by this agreement,
 the buyer has the right to cancel such portion of this contract as may
be effected thereby by giving proof by affidavit executed by the president or
one of the officers of the buyer, setting forth the existence of the impediments
preventing the using of said goods; provided said goods shall not have been
shipped or vessels to carry the same shall not have been chartered prior to
