notice being given to the syndicate or its representatives in the United States
vf the existence of such impediments.
(16) United States taxes or duties.—The buyers hereby assume and agree to
pay any tax or duty which may be imposed or assessed by the United States
Government and any war insurance risk affecting deliveries under this contract.
(17) Discharge of goods—Buyer shall receive potash salts in northern ports
as soon and as fast as vessel is ready to dicharge and in southern ports at
the rate of not less than three hundred (300) tons of 2,240 lbs. per day, Sundays
 and holidays excepted and weather permitting.
On shipments to southern ports the syndicate agrees to stipulate in charterparties
 that the steamer shall discharge at two (2) wharves, provided there
is a sufficient depth of water at such wharves. Buyers guarantee, however,
only 19% feet of water at Wilmington, N. C., and only twenty (20) feet of water
at Mobile, Ala. The syndicate, whenever possible, shall also stipulate in
charter-parties for discharge at a third wharf, but in such case the buyers
shall pay the expense of removal of the steamer from the second to the third
wharf.
(18) Protection.—If potash salts from potash mines should be offered for
shipment to the United States, Atlantic or Gulf ports for fertilizer purposes
at lower prices than those named in this contract after deduction of cash and
other discounts, buyer shall be entitled to buy them. Buyer shall, however,
immediately give notice with full particulars to the syndicate’s American representative.
 Syndicate shall then have the option within a reasonable time of
either taking such purchase over for its own account or to allow buyer to
keep said goods for itself, deducting a like amount of K:O from the quantity
contracted for with the syndicate.
In case, however, potash salt shall be furnished for fertilizer purposes
within the United States during the existence of this contract, and at least
three thousand (3,000) tons muriate or twelve thousand tons kainit and other
grades of salts in the same proportion, or either or any of such grades shall
be sold at prices lower than provided for in this contract after deduction of
cash and other discounts as hereinbefore stated, and in case the buyer shall
be unable to purchase and acquire the same as in this article set forth, then
and in that event the syndicate agrees as follows:
First. That it will protect the buyer against such reduced prices to the
extent that it may legally do under the potash law applicable thereto, either
by reducing prices to meet the cut in prices made as aforesaid, or the syndicate
will deliver to the buyer the same proportion of the grade of salts sold at such
cut prices which the entire purchases of the buyer shall bear to all the purchases
 from the syndicate made by fertilizer manufacturers in the United
States under contracts similar to this agreement during the year in which such
cut shall be made. In case, however, the syndicate shall be unable to reduce
prices or deliver potash at such reduced prices as hereinbefore stated. then
and in that event.
Second. The purchaser shall have the right, on notice to the syndicate or
its United States representative, to cancel and terminate so much of the contract
 as shall cover the grade of salt for which the price has been reduced as
hereinbefore stated, and which reduction of prices the syndicate is unable
to meet as above set forth, but in the event the buyer shall expect to cancel
such portion of the contract then the syndicate shall have the right at its
option, on notice to the buyer, to cancel and terminate the agreement with
reference to any other salts covered by this agreement in whole or in part
for the balance of the term fixed in this contract.
(19) Scale of discounts.—The syndicate will give the discount mentioned
in this contract only to actual manufacturers of fertilizers who shall buy at
least twenty thousand (20,000) tons of K:0 annually. For smaller quantities
discounts shall not be allowed in excess of the rates and on the basis of tonnage
 as follows:

For at least 15,000 tons
For at least 10,000 tons
“or at least 5,000 tons
For at least 1.000 tons K.
