38 & 39 Vict. Cap. 60, s. 33. 
(c.) All penalties may lie enforced in default of payment 
by imprisonment for a term to be specified in the 
order or conviction, but not exceeding three 
months : 
(d.) All penalties recovered shall be paid to the sheriff 
clerk, and by him accounted for and paid to the 
Queen’s and Lord Treasurer’s Remembrancer on 
behalf of the Crown : 
(e.) The sheriffs and their substitutes shall have all juris 
diction, power, and authority necessary for giving 
effect to these provisions. 
(5.) Description of offences.—In any information or com 
plaint under this Act it is sufficient to describe the offence 
in the words of this Act, and no exception, exemption, 
proviso, excuse, or qualification accompanying the descrip 
tion of the offence in this Act need be specified or nega 
tived. 
(6.) Appeals.—In England or Ireland any party may 
appeal from any order or conviction made by a court of 
summary jurisdiction on determining any complaint or 
information under this Act as follows (a) 
(a.) The appeal shall be made to some court of general 
or quarter sessions for the county or place in 
which the cause of appeal has arisen, holden not 
less than fifteen days and not more than four 
months after the decision appealed from : 
(6.) The appellant shall, within seven days after the 
cause of appeal has arisen, give notice to the 
other party and to the court of summary juris 
diction of his intention to appeal, and of the 
ground thereof: 
(e.) The appellant shall, immediately after such notice, 
enter into a recognizance before a justice of the 
peace in the sum of ten pounds, with two suffi 
cient sureties in the sum of ten pounds, condi 
(a) Further, as to procedure on' appeal, see ss. 31, 32, 33 of 
Summary Jurisdiction Act, 1879 (42 & 43 Viet. c. 49).
