INTRODUCTION.

40.  A  Friendly  Society  may  not  be  dissolved
voluntarily  without  the  consent  of  five-sixths  in
value  of  the  members,  including  honorary  members,,
and  of  all  those  receiving  any  relief,  annuity,  or
benefit,  unless  the  claims  of  such  persons  are  duly
satisfied,  or  adequate  provision  made  for  the  purpose. ­
  The  instrument  of  dissolution  must  either
set  forth  the  intended  division  or  appropriation  of
the  funds,  or  refer  such  matter  to  the  Registrar.
Where  the  society  is  in  an  insolvent  state,  the
Registrar  may,  upon  the  application  of  one-fifth  in
number  of  the  members  (or  of  a  less  proportion  in  a
society  of  1,000  members  or  more)  dissolve  the
same  compulsorily,  by  award,  if  he  shall  upon
investigation  so  think  fit,  and  may  direct  how
the  funds  and  property  of  the  society  are  to  be
divided.  The  dissolution  is  in  either  case  to  be
advertised  in  the  Gazette,  and  in  a  county  newspaper, ­
  by  the  Registrar,  and  is  binding  and  effectual ­
  on  all  persons,  unless  proceedings  are
taken  by  any  member  to  set  it  aside  within  three
months  from  the  date  of  the  advertisement.
41.  A  Friendly  Society  may,  by  special  resolution, ­
  amalgamate  with,  or  transfer  its  engagements ­
  to  any  other  society  upon  the  like  consent,
and  subject  to  the  same  restrictions  as  provided
for  the  case  of  dissolution.
42.  No  person  by  reason  of  enrolment  or  service ­
  in  the  militia,  naval  coast  volunteers,  naval
reserve  volunteer  force,  yeomanry,  or  volunteers,
will  lose  or  forfeit  any  interest  in  a  Friendly  Society,,
registered  or  unregistered,  notwithstanding  any
rule  of  such  society  to  the  contrary;  but  in  a.
