von dem Kalisyndikat eine für alle Kaliwerke geltende Bürgschafts- 
erklärung abgegeben worden. Soweit über die Ansprüche einzelner Ar- 
beiter eine Einigung zwischen den Parteien nicht erzielt werden konnte, 
wurden die Streitfälle dem gemäß $ 85, Absatz 5 gebildeten Schieds- 
gericht zuständigkeitshalber überlassen. Verschiedene Werke verein- 
barten mit den Arbeiterverbänden die Zahlung einer größeren Abfin- 
dungssumme, aus der die einzelnen Belegschaftsmitglieder entschädigt 
wurden. 
Von dem Gesetzgeber war ursprünglich, um die Stillegung zu be- 
schleunigen, für die Abgabe der Stillegungserklärung nur eine verhältnis- 
mäßig kurze Frist festgesetzt worden, die mit dem 1. April 1923 ablief. 
Sie wurde vor Ablauf bis zum 1. Juli 1924 verlängert. Es zeigte sich 
jedoch auch noch in der ersten Hälfte des Jahres 1924, daß die Wirt- 
schafts- und Absatzverhältnisse der Kaliindustrie derart ungeklärt 
waren, daß die meisten Konzerne sich über die endgültige Zusammen- 
legung der Betriebe noch nicht schlüssig werden konnten. Infolgedessen 
hatten nach den Feststellungen der Kaliprüfungsstelle bis zum 1. April 
1924 nur 45 Werke den Antrag auf freiwillige Stillegung eingereicht, 
Es war aber nach Lage der Verhältnisse anzunehmen, daß noch eine 
erheblich größere Zahl von Werken von dem in $ 83a—e einge- 
räumten. Recht Gebrauch machen würde, wenn. ihnen genügend Zeit zur 
Durchführung ihrer Stillegungspläne gelassen würde. Der Reichskali- 
rat erkannte aus dem Ergebnis der bisherigen Konzentrationsmaß- 
nahmen, daß es nur möglich sein würde, die Zahl der Produktions- 
stätten noch weiter wirksam einzuschränken, wenn die Stillegung 
allmählich und unter Vermeidung von Gewaltmitteln erfolgte. Er be- 
antragte daher auf Empfehlung der Kaliprüfungsstelle, bei der Reichs- 
regierung die in $ 83a enthaltenen Fristen und insbesondere die Frist 
für die Abgabe der Stillegungserklärung nochmals hinauszuschieben. 
Dem Vorschlage iet durch Erlaß der Verordnung vom 28. Juni 
1924*) entsprochen worden. Ale endgültiger Endtermin für die Abgabe 
der Stillegungserklärung wurde in ihr der 1. Januar 1926 festgesetzt. 
Außerdem wurde die Frist, innerhalb der die Einstellung der Förderung 
nach Anordnung der Kaliprüfungsstelle spätestens erfolgen mußte, bis 
zum 1. Januar 1927 verlängert. Vom 1. Januar 1926 ab sollten außer- 
dem von der Kaliprüfungsstelle fortlaufend Untersuchungen über eine 
etwaige zwangsweise Stillegung von Werken wegen nachgewiesener 
dauernder Unwirtschaftlichkeit vorgenommen Werden. 
Zum Schutze der Arbeitnehmer wurden in der gleichen Verordnung 
die Vorschriften des $ 85 Absatz 6 dem Vorschlage des Reichskalirate 
entsprechend dahin ergänzt, daß gegen die Entscheidung des Schieds- 
gerichts nur dann der ordentliche Rechtsweg zulässig sein sollte, wenn 
sie mit weniger als 4 Stimmen erfolgte. Der Zweck dieser Ergänzung 
war, Streitigkeiten über. die Entschädigungspflicht der Werke gemäß 
S 85 möglichst abzukürzen, damit die Arbeitnehmer schnell in den Genuß 
der. ihnen zustehenden Abfindungsbeträge gelangten. -
