des betretende» Beamten so weiten Spielraum, dass 
er uns gegen die hier befürchteten missbräuchlichen 
Denunziationen eine unbedingte Sicherheit nicht zu 
bieten scheint.*) Dass der Denunziant nach Alinea 3 
dieses Paragraphen dem Hoard of Trade für die 
Kosten der Anhaltung und Untersuchung des Schiffes 
und für die eventuellen Entschädigungsansprüche des 
Sehiffseigners haften soll, hat bei mittellosen Personen 
selbsverständlich keine Bedeutung. Die ganze Sicher 
heit gegen frivole und böswillige Denunziationen durch 
unzufriedene Schiffsleute liegt also ebenfalls lediglich 
in der Persönlichkeit und dem Verfahren des Englischen 
Delainitiff officer, d. h. eines ausländischen Beamten, 
auf dessen Auswahl und Amtsführung Deutschland 
keinerlei Einfluss hat. Wir glauben daher, dass es 
rathsam ist, in dieser Beziehung durch unsere eigene 
Gesetzgebung eine anderweitige Garantie zu schaffen. 
Nach § 105 der Deutschen Seemanns - Ordnung 
„darf der Schiffsmann den Schiffer vor einem fremden 
*) §11 lautet: , Where a complaint is made to the Board 
of Trade or a detainimj officer that a British ship (nach § 13 gilt 
(lies auch für fremde Schiffe) is unsafe, the Board or officer map , if 
they or he think fit, require the complainant to gire security to 
the satisfaction of the Board for the costs and compensation which he 
may become liable to pay as hereinafter mentioned. 
Provided that where the complaint is made by one fourth, 
beiny not less than three, of the seamen belonging to the ship, and is 
not in the opinion of the Board or officer frivolous or vexatious, 
such security shall not be r equired, and the Board or officer 
shall, if the comjilaint is made in sufficient time before the sailing 
of the ship, take proper steqis for ascertaining whether the ship ought 
to be detained under this Act. 
Where a ship is detained in consequence of any complaint, and 
the circumstances are such that the Board of Trade are liable under 
this Act to pay to the owner of the ship any costs or compensation, 
the comjilainant shall be liable to pay to the Board of Trade all such 
costs and compensation as the Board incur or are liable to pay in 
respect of the detention and survey of the ship.
