Das Schulzwangsgesetz (Artikel 19) besteht, wie wir sehen,
aus 2 Teilen.
Der erste Teil gebietet, dass jedes Kind, — von Ausnahmen
abgesehen, — zwischen dem vollendeten 7. und dem vollendeten
14. Lebensjahre die Schule zu besuchen hat, wenn es im Bereiche
derselben wohnt oder auf Staatskosten in deren Bereich gebracht
wird. Ein solches Kind ist also für 7 Jahre schulpflichtig und
wird unter normalen Verhältnissen in dieser Zeit den „Standard“ VI
absolvieren können.
Das Gesetz lässt aber — Artikel 19 (Id) — zu, dass ein
Kind nach absolviertem „Standard“ IV, also bereits nach dem
vollendeten 5. Schuljahre, die Schule verlässt, falls es in ein regelrechtes
Dienstverhältnis tritt. Es ist somit in Wirklichkeit der
absolvierte „Standard“ IV die Bildungsgrenze . für die Schulpflichtigen.
Die Volksschulen Transvaals lassen nun, obwohl die untere
Grenze des Schulzwanges das vollendete 7. Lebensjahr ist, bereits
Kinder, welche das 5. Lebensjahr abgeschlossen haben, zum Unterricht
zu. Es kann demnach ein Kind schon am Ende des 11. Lebensjahres
den „Standard“ IV absolvieren und von seinen Eltern
aus der Schule genommen werden. Leider machen auch viele
Eltern von dieser Bestimmung Gebrauch,
a) is in the opinion of the board receiving efficient instruction in some other
manner;
b) lives more than three miles by the nearest road from a school in which
there is the necessary accommodation and is not provided by the department
with facilities for transport to such school;
°) is prevented from ill-health, or any other cause whether temporary or permanent
which the board may deem a sufficient excuse for nonattendance;
4) is in regular employment and has satisfactorily completed a course prescribed
by regulation for the fourth standard of primary schools or an
equivalent course whereof a certificate under the hand of an inspector of
education shall be conclusive evidence.
2) The Governor may from time to time by proclamation in the Gazette vary
the provisions of this section in respect of all Schools or of schools in parti-Cular
areas by
a) changing the limits of age between which attendance at school shall be
compulsory; provided that the upper limit shall not be below the age
of fourteen years and the lower limit not below the age’ of seven years; or
b) raising the standard of exemption above the fourth standard.
